The petitioner seeks bail in a case registered under Sections 406, 420, 409 of the Indian Penal Code. Earlier prayed for bail of the petitioner was rejected vide Annexure-1 to the application.

A report was called for from the trial court regarding present stage of the case. It appears that the trial court has reported that the trial is likely to be concluded within a period of six months.

Counter affidavit has been filed on behalf of the Bihar State Food & Civil Supply Corporation Ltd, Madhubani.

Patna High Court CR. MISC. No.6329 of 2019(6) dt.17-07-2019 2/2 Following statement has been made in paragraph-9 of the counter affidavit- "That it may humbly be stated and submitted that the O.P. No. 2 is committed to cooperate with the learned Trial Court in order to complete the trial within six months and will take all possible steps to get the official witnesses be examined within the aforesaid period".

Considering the aforesaid facts, I am not inclined to grant bail to the petitioner. Accordingly, prayer for bail of the petitioner in connection with Basopatti P.S. Case No. 44 of 2016 stands rejected.

The court below is directed to take all necessary steps to conclude the trial of the petitioner, preferably, within a period of six months from the date of receipt/production of copy of the order.

The O.P. No. 2 is directed to ensure that the witnesses will be produced on each and every date fixed in the case. (Sudhir Singh, J) A.K.V.//- U T
