The petitioner seeks bail in a case registered under Section 3 of the Railway Property (Unlawful Possession) Act. Allegation is that the accused persons looted computer peripherals, which were booked from Anand Vihar railway station.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 26.10.2019 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner had no knowledge that the railway property being kept in the car in question. The car in question does not belong to the petitioner. He was co-passenger

Patna High Court CR. MISC. No.9174 of 2020(2) dt.04-03-2020 2/2 in the car. Other co-accused have been granted bail vide Cr.Misc.No.13229 of 2020 and 3680 of 2020.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Railway Magistrate, Gaya in connection with R.P.F. Gaya P.S. case No.26 of 2019.
