Petitioner is not named in the first information report and it appears that in course of investigation, name of the petitioner surfaced in this case and thereafter, confessional statement of co-accused was recorded and co-accused also named the petitioner. Petitioner does have antecedent of only one case i.e. Mali P.S. Case no. 43/2009.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad in Mali P.S. Case no. 38/2009.
