2. The petitioners apprehend their arrest in connection with Kundwa Chainpur P.S. Case No. 164 of 2020 dated 22.10.2020 registered for the offences punishable under sections 147, 149, 323, 279, 379, 354, 307, 504, 506, 327 and 338 of the Indian Penal Code.
3. The main submissions advanced by learned counsel appearing for the petitioners are that the petitioner No. 1 is a lady and the petitioner No. 2 is brother of the petitioner No. 1 and both the petitioners have no criminal antecedent, in the FIR altogether twenty persons including the petitioners have
Patna High Court CR. MISC. No.9773 of 2025(2) dt.14-02-2025 2/3 been named and 10-15 unknown persons, male and female, have been shown as being involved in the alleged occurrence. The first part of the alleged occurrence relates to running a tractor over the cousin brother of the informant but the said allegation is against co-accused Rahmat Alam with whom the petitioners have no any kind of relationship and the allegation which has been levelled against the petitioners mainly relates to abusing and the same is not specific against the petitioners. It is further submitted that as per the informant, the alleged occurrence was committed by the accused persons on account of murder of his uncle for which Kundwa Chainpur P.S. Case No.
105 of 2020 was lodged and as per the informant, the accused persons were pressurizing him in that case but both the petitioners have no any relationship with the deceased of Kundwa Chainpur P.S. Case No. 105 of 2020, so, there was no reason for the petitioners to be involved with other co-accused persons to commit the alleged occurrence or create pressure upon the prosecution party in the said Kundwa Chainpur P.S. Case No. 105 of 2020 as alleged by the informant.
4. Learned APP appearing for the State has opposed the prayer of the petitioners.
5. Considering the aforesaid submissions advanced
Patna High Court CR. MISC. No.9773 of 2025(2) dt.14-02-2025 3/3 by petitioners' counsel and mainly the nature of allegation appearing against the petitioners from the FIR as well as their fair and clean antecedent, this Court is inclined to grant the relief of anticipatory bail to the petitioners. Accordingly, let the petitioners named-above, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned in connection with Kundwa Chainpur P.S. Case No. 164 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
