2. The petitioner has preferred this application for grant of regular bail in connection with K-Hat P.S. Case No. 511 of 2024 (Special NDPS Act Case No. 171 of 2024) dated 15.10.2024 registered for the offences punishable u/ss 8 (c)/21(b) of the NDPS Act.
3. As per the prosecution case, total 47 packets of smack (weight 12.614 gm), Rs. 8,523/- and a mobile phone were recovered from the possession of the co-accused Dhirendra Kumar and Rs. 5,650/- and a mobile phone were recovered from the possession of the petitioner.
4. Learned counsel for the petitioner has submitted
Patna High Court CR. MISC. No.7596 of 2025(2) dt.18-03-2025 2/2 that the petitioner is innocent and has falsely been implicated in this case. The seized contraband is less than the commercial quantity. No incriminating material has been recovered from the conscious possession of the petitioner. Similarly situated coaccused has already been granted bail by the co-ordinate bench of this court vide order dated 15.12.2025 passed in Cr. Misc. No. 2814 of 2025. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 15.10.2024.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Purnea in connection with K-Hat P.S. Case No. 511 of 2024 (Special NDPS Act Case No. 171 of 2024).
7. The application stands allowed.
