1. The Writ petition is filed to command the respondents to pay the earnest money and security deposit amounting to appropriately Rs. 11 lakhs which is due to the petitioner for the completion of the work allotted to him.

2. During the course of arguments, the Learned counsel for the respondents sought time to report to the Court about negotiations which took place, to settle the amount of the petitioner

Patna High Court CWJC No.13931 of 2017(6) dt.29-08-2025 2/3 and the same was recorded by order dated 21.08.2025.

3. Further, the Learned counsel for the respondents placed the minutes of the meeting held on 27.08.2025. The said minutes disclose that the Committee had decided the matter in the presence of the petitioner and it was mutually agreed between the parties that the competent authority, NBCC (India) Limited, shall pay a total sum of Rs. 8,42,322/- to M/s Arjun Engicon Private Limited i.e. petitioner on account of security deposit, Rs. 2,92,500/-, on account of withheld payment for work, and Rs. 2,67,700/- towards security deposit for the work.

4. Further, the minutes of the meeting disclose that upon receipt of payment, M/s Arjun Engicon Private Limited i.e. petitioner shall withdraw the present Writ petition i.e. CWJC No. 13931 of 2017, pending before the Court. The 3rd clause of the minutes disclose that the settlement shall be binding on the parties and the same shall be placed before this Court on the next date of

Patna High Court CWJC No.13931 of 2017(6) dt.29-08-2025 3/3 hearing for appropriate orders.

5. Construing that the respondents are willing to pay a total amount of Rs. 42,02522/- this Court is of the considerable view that nothing further survives for adjudication. Therefore, the Writ petition is hereby disposed of and the payment shall be made by the respondents to the petitioner at the earliest possible time, not exceeding three months.

6. With the aforesaid observations, the Writ petition is disposed of.
