Learned counsel for the petitioner is permitted to make necessary correction in para 1 of the petition. Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under sections 25(I-b)a and 26 of the Arms Act. Allegedly, from the possession of this petitioner one country made pistol with one live cartridge was recovered. The main submissions advanced by the learned counsel for the petitioner are that the petitioner has been languishing in jail since 05.11.2021 and he has one criminal antecedent under Excise Act in which he is on bail.

Learned APP has opposed the prayer for bail and

Patna High Court CR. MISC. No.6206 of 2022(3) dt.27-07-2022 2/2 submitted that from the possession of the petitioner firearm was recovered and he has criminal antecedent also. Heard both sides, perused the FIR and case diary. As per FIR petitioner is stated to be 21 years old and case diary shows that investigation in respect of the petitioner has been completed and he has been languishing in jail since 05.11.2021. Though petitioner has criminal antecedent but he is on bail as per above submissions. Considering these facts and mainly taking into account petitioner's young age and his custody period, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sheikhpura in Sheikhpura P.S Case No. 563 of 2021.
