In this case, the petitioner is seeking regular bail in connection with Kanti P.S. Case No. 556 of 2022, registered for the offences punishable under Sections 392, 395, 412 of the Indian Penal Code.
As per allegation, some unknown criminals at the point of firearm has taken away the vehicle of the informant. It has also been mentioned in the FIR that one Md. Danish (coaccused) who was involved in occurrence of similar nature was unknowingly hired as driver of tempo of Bhavani Traders was apprehended. The co-accused Vicky Dom, Bittu Dom had also come to meet him.
The learned counsel for the petitioner has submitted
Patna High Court CR. MISC. No.6267 of 2023(2) dt.08-05-2023 2/2 that nothing was recovered from the possession of the petitioner. He was not put on TIP and the named accused Md. Danish has been granted bail. The petitioner is under custody since 29.08.2022.
Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Muzaffarpur West in connection with Kanti P.S. Case No. 556 of 2022, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
(ii) If the petitioner is found involved in future in the similar type of offense, the prosecution will have liberty to file an application before the court below for cancellation of the bail of the petitioner and the learned court below will take decision in accordance with law.
