Petitioner is in custody in connection with Deo P.S. Case No. 56 of 2018 for the offence under sections 420, 406 and 409 of the Indian Penal Code.
Learned counsel for the petitioner submits that petitioner has no criminal antecedent. He submits that the allegation against the petitioner in the instant case is that the petitioner has transferred the money to unauthorized person because of the fact that he is member secretary of Sat Nishchay Yojana.
Learned counsel submits that he has countersigned the cheque made in favour of one Nayeem Ansari and Nayeem Ansari has returned Rs. 5.60 lacs in the account of Premlata
Patna High Court Cr.Misc. No.6532 of 2019(2) dt.05-02-2019 2/2 Kumari of Ward No.2.
The petitioner is in custody since 27.11.2018. Considering the fact that Rs. 5.60 lacs has already been returned in the account of Premlata Kumari, Ward Member of Ward No.2, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Aurangabad, in connection with Deo P.S. Case No. 56 of 2018 subject to the condition that while releasing the petitioner the court below shall verify the fact whether the said amount was returned in the account of Premlata Kumari, Ward member of Ward No.2 or not?
