The seized motorcycle has been recovered from possession of four persons including the petitioner and according to the prosecution case itself, at the time of recovery; the seized motorcycle was being driven by another accused.

Considering the aforesaid facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with
