The petitioner seeks bail in a case registered under Sections 307, 353, 34 of the Indian Penal Code and Sections -25(1-b)(a), 26, 27, 35 of the Arms Act.

The prosecution case, in short, is that the informant with police personnel went to the place of occurrence, where the accused persons made indiscriminate firing, as a result of which, two police personnel sustained fire arms injury. It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 29-05-2018. Charge sheet in this case has already been submitted. The

Patna High Court CR. MISC. No.12767 of 2019(2) dt.11-04-2019 2/2 petitioner has been falsely implicated in the present case. There is allegation of causing injury on non-vital part of the body. It has further been submitted that the petitioner may be released after completion of one year in custody.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that after completion of one year in custody, the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Ravi Ranjan, learned Judicial Magistrate-Ist Class, Begusarai in connection with Begusarai Town P.S. Case No. 138 of 2018.
