The petitioner is languishing in custody since 02.06.2014 in a case registered for the offences punishable under Sections 341, 323, 307, 504 and 506 of the Indian Penal Code.

It is alleged that the co-accused Bakhiya Devi assaulted the informant with lathi on his back and this petitioner assaulted with spade on the head causing grievous injury, thereafter the petitioner also made assault with Khanti. It is submitted by learned counsel for the petitioner that in the background of petty dispute the occurrence took place. The petitioner has no intention to kill the informant.

Patna High Court Cr.Misc. No.36526 of 2014 (03) dt.13-01-2015 2/2 Petitioner is the agnate of the informant. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Banka in connection with Amarpur P.S.
