2. The petitioner is in custody in connection with Bhabua P.S. Case No. 1018 of 2023 registered for an offence punishable under Sections 366A of the Indian Penal Code.

3. As per allegation in the FIR, it is a case of missing of the minor niece of the informant.

4. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. He next submits that the name of the petitioner came during course of investigation and the statement recorded of the victim under Section 164 of the Cr.P.C. wherein she has stated that she had voluntarily gone with the petitioner and she had already married

Patna High Court CR. MISC. No.10254 of 2024(2) dt.21-02-2024 2/2 with the petitioner with her own sweet will. Petitioner is in custody since 29.11.2023.

5. The learned APP for the State as well as learned counsel for the Informant opposes the prayer for regular bail of the petitioner.

6. Considering the aforesaid facts and submissions as made in 164 of the Cr.P.C. of the victim, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Bhabua, Kaimur in connection with Bhabua P.S.
