Mr. Manish Kumar No.2, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SANDEEP KUMAR ORAL ORDER 20-06-2025 Heard the learned senior counsel for the petitioner, the learned APP for the State and learned counsel for the informant.

2. The petitioner seeks regular bail in a case registered for the offence under Sections 147, 148, 149, 341, 323, 325, 307, 427 and 506 of the Indian Penal Code.

3. This is the 3rd attempt of the petitioner. Earlier the bail application of the petitioner was rejected twice vide order dated 31.01.2024 and 05.10.2024 passed in Cr. Misc. No. 3133 of 2024 and Cr. Misc. No.63986 of 2024 respectively.

4. After the prayer for bail of the petitioner was rejected on 05.10.2024, the petitioner moved before the Hon'ble

Patna High Court CR. MISC. No.6486 of 2025(4) dt.20-06-2025 2/3 Supreme Court for bail in SLP (Cr.) No.17217 fo 2024. The aforesaid SLP (Cr.) No.17217 of 2024 was dismissed as not pressed by the Hon,ble Supreme Court on 13.12.2024.

5. The following order was passed on 13.12.2024 in SLP (Cr.) No.17217 of 2024:-

1. Learned counsel for the petitioner does not wish to press the present Special Leave Petition and seeks liberty to renew the prayer for bail before the High Court after some time.

2. Accordingly, the Special Leave Petition is dismissed as not pressed with liberty as sought for.

6. Learned senior counsel for the petitioner submits that the petitioner is innocent and has not committed any offence. The petitioner is in custody since 03.10.2023.

7. Learned counsel for the informant has submitted that one witness has been examined and he is being crossexamined by the defence.

8. The second bail application of the petitioner was rejected by this Court on 05.10.2024 and thereafter, in more than seven months only one witness has been examined. It appears that the interest of the prosecution is not of getting the trial concluded but keeping the petitioner in jail as only one

9. Considering the facts and circumstances of the case, the period of custody as well as the fact that the prosecution is delaying the trial, this application for regular bail is allowed.

10. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-IX, Gaya/concerned Court below in connection with Khizersarai P.S. Case No. 267 of 2023.
