Petitioner was in-charge of Upgraded middle school, Belai Pothia and accusation against him is that he as well as secretary of the concerned school withdrew Rs 6, 14, 400/- for distribution of the aforesaid amount among the students of the above stated school but the petitioner misappropriated the aforesaid amount. The contention on behalf of the petitioner is that the above stated amount could not be distributed among the beneficiaries due to some unavoidable circumstance, and subsequently, aforesaid amount was deposited in the account of the concerned school which is evident from annexure 3 to the petition.

Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate,
