JUSTICE VIKASH JAIN ORAL JUDGMENT Date: 30-03-2018 The present writ petition has been filed for quashing the order issued under the signature of respondent no. 3 vide memo no. 91 dated 03.02.2018 (Annexure-1) by which, pursuant to a decision of Mid-Day Meal Scheme Committee, District Supaul dated 03.02.2018, petitioner' tender for lifting the rice from the godown of State Food Corporation has been declared ineligible; and for connected reliefs.

2. At the very outset, learned counsel for the petitioner submits that it will suffice if the petitioner's representation dated 24.01.2018 (Annexure-5) filed before the Director, Mid-Day Meal

Patna High Court CWJC No.4816 of 2018 dt.30-03-2018 2/2 Scheme, Department of Education, Government of Bihar, Patna (respondent no. 2) is directed to be disposed of, in which event, the present writ petition need not be pressed on merits.

3. Learned counsel for the State appears and has been heard.

Having regard to the nature of the grievances and the stand of the petitioner, the present writ petition is disposed of with a direction to the Director, Mid-Day Meal Scheme, Department of Education, Government of Bihar, Patna (respondent no. 2) to consider and dispose of the petitioner's representation dated 24.01.2018 (Annexure-5), if the same is still pending before him, after grant of opportunity of hearing to the petitioner in accordance with law expeditiously and preferably within a period of eight weeks from the date of receipt/production of a copy of this judgment.
