JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-03-2020 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Bochahan P.S.Case No. 322 of 2019 registered for the offence punishable under sections 272, 273 and 120B of the Indian Penal Code and section 30(a) of Bihar Prohibition and Excise Act.

The written report shows that the alleged recovery has been made from the premises of the petitioner. Therefore, in my view, this anticipatory bail is not maintainable. Accordingly, this anticipatory bail petition stands dismissed being not maintainable.

However, if the petitioner surrenders and seeks regular bail within six weeks, the concerned court shall consider
