Petitioner seeks bail in a case registered for the offences punishable under Sections 376,341,323,504/34 of the Indian Penal Code and 3/4 of the POCSO Act.
Allegation is that the petitioner initially ravished the informant by putting her in threat of murder. Thereafter, he was in physical relation by inducing her that the petitioner would marry with her. When she was pregnant, the petitioner refused to marry.
Learned counsel for the petitioner submits that in fact the victim was already a married lady and just to put pressure for marriage, she lodged this false case. The witnesses have stated that just to extract money, she is in habit of falsely implicating others. Though the informant was noticed in this

Considering the facts of this case aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Special Case No.26 of 2017 arising out of Araria (Mahila) Police Station Case No.43 of 2017, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
