2. The petitioner seeks bail in connection with Akbarpur P.S. case No. 656 of 2021, instituted for the offences under Sections 341, 323, 325, 307, 302/34 of the Indian Penal Code.

3. Prosecution allegation, in short, is that the petitioner along with other accused persons, armed with weapons, assaulted the father and brother of the informant due to which they sustained injuries and the father of the informant succumbed to injury. The family members who came to rescue

Patna High Court CR. MISC. No.8432 of 2024(2) dt.19-02-2024 2/3 were also assaulted by the accused persons. It is further alleged that this petitioner assaulted Suraj Kumar with knife.

4. Learned counsel for the petitioner submitted that the petitioner has falsely been implicated in the present case. Learned counsel further submitted that the informant and accused are gotias and there is admitted land dispute between the parties. Learned counsel further submitted that the only specific allegation levelled against this petitioner is that the petitioner gave knife blow to Suraj Kumar but his injury report is not available on record, as stated in impugned order dated 04.01.2024. It has been submitted on behalf of the petitioner that the petitioner is in custody since 25.06.2023 and has no criminal antecedent.

5. Learned counsel for the Informant has vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the aforesaid facts and circumstances of the case, land dispute between the parties and the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.

7. Let the petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Court
