JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-11-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Earlier the prayer for bail of the petitioner was rejected by a co-ordinate Bench of this Court but submission on behalf of the petitioner is that petitioner is in jail custody since 05.03.2014 but up till now, his trial could not be concluded. The trial court has reported that till 17.08.2015, only one prosecution witness could be examined.

The accusation against the petitioner is that he caught hold the deceased at the time of alleged occurrence whereas it was co-accused, Kari Sah, who stabbed the deceased. Considering the aforesaid facts and circumstances as
