JUSTICE MOHIT KUMAR SHAH ORAL ORDER 28-11-2025 At the outset, the learned counsel for the opposite parties submits that as far as Khesra No. 607 is concerned, the settlement of the same is existing in favour of the father of the petitioner, hence the government authorities, under the provisions contained in the Bihar Public Land Encroachment Act, 1956 are not entitled to remove the encroachment existing over private Raiyati land.

At this juncture, the learned counsel for the petitioner has raised a new grievance to the effect that though the settlement of Khesra No. 607 is existing in favour of the father of the petitioner, however illegally proposal is being mooted for cancellation of the settlement in question, hence the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the concerned authority for raising grievance, in accordance with law.

3. Liberty, so sought, is granted.
