JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 24-07-2019 Learned counsel appearing on behalf of the petitioner states that the order, violation of which is being complained of in the present contempt application, has been complied with, but partly. According to him, though the petitioner is entitled for MACP, the same has been denied illegally by the opposite parties.

The refusal by the opposite parties to grant the petitioner MACP cannot be questioned in the present contempt proceeding. There was no direction to the opposite parties to

Patna High Court MJC No.489 of 2018(2) dt.24-07-2019 2/2 allow the petitioner MACP.

This proceeding is accordingly dropped with liberty to the petitioner to question the decision of the opposite parties refusing him benefit of MACP in appropriate proceeding in accordance with law.
