JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-04-2019 This application, for grant of anticipatory bail, arises out of Complaint Case No. 1818 of 2017, disclosing offences under Sections 354, 323 and 341 of the Indian Penal Code. Petitioner happens to be Nandoshi (brother in law) of the complainant and allegation against him is trying to outrage the modesty of the complainant.
Submission of learned counsel for the petitioner is that there is property dispute between the parties and the real fact is that the complainant is a widow of brother -in-law of the petitioner and she is in habit of selling the land and a title suit i.e. Title Suit No. 459/2014 is going on between the parties and due to which, this present false and concocted case has been

Heard learned A.P.P. also as well as learned counsel for the complainant. Learned counsel for the complainant opposed the prayer for bail, however, he could not controvert the fact that a title suit is going on between the parties. Having heard both sides, in view of the above facts this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate -1st Class, Bhagalpur, in connection with Complaint Case No. 1818 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
