JUSTICE DINESH KUMAR SINGH ORAL ORDER 30-01-2015 Petitioner is languishing in custody since 01.06.2014 in a case registered for the offences punishable under Sections 365/34 of the I.P.C.

Accusation is kidnapping the son of the informant. From the door of the petitioner the vehicle of the informant was recovered.

It is submitted by learned counsel for the petitioner that the vehicle was parked by the miscreants at the door of the petitioner who is neighbour of the informant. The victim in his 164 Cr.P.C statement has named Lakhan Sah and not named this petitioner.

A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail

Patna High Court Cr.Misc. No.35979 of 2014 (6) dt.30-01-2015 2/2 bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Ahiyapur P.S. Case No. 287 of 2014.
