The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act, 2016 as amended by Amendment Act 8 of 2018. It is alleged that 28.500 litres of Nepali liquor were recovered from the bushes behind the house of the petitioner. It is submitted by learned counsel for the petitioner that the recovery cannot be treated from the conscious physical possession of the petitioner and a statement has been made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent.
Learned APP submits that the recovery has been made
Patna High Court CR. MISC. No.4628 of 2020(2) dt.29-02-2020 2/2 from the bushes behind the house of the petitioner. Considering the fact that prima facie the recovery does not appear to have been made from the conscious physical possession of the petitioner and statement being made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II -cum- Special Judge, Excise Act, Madhubani in connection with Ladaniya P.S. Case No. 213 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
