2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 105 and 3(5) of the B.N.S..

3. As per prosecution case, on 15.09.2025 at about 2 PM, while the informant was installing electric pole, in the meantime, this petitioner, along with co-accused person, came and scuffled with the informant. It is further alleged that during course of scuffle, this petitioner and co-accused Saurabh Kumar pushed the father of informant as a result of which, he fell down on the root of a tree and succumbed to the injuries.

4. It is submitted by learned counsel appearing on

Patna High Court CR. MISC. No.5405 of 2026(2) dt.03-02-2026 2/3 behalf of the petitioner that petitioner is quite innocent and has committed no offence. From bare perusal of the F.I.R. it is apparent that the act was committed without pre-meditation in a sudden fight in the heat of passion. As a matter of fact, during quarrel, father of informant fell on the root of the tree due to which, he succumbed to the injuries. It was an accidental death. Even as per post mortem report, no external injury was found on the person of the deceased. Petitioner claims clean antecedents.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner.

6. Considering the facts and circumstances of the case, general and omnibus nature of accusation and clean antecedents of the petitioner, the prayer for grant of anticipatory bail to the petitioner is allowed.

7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-1st, Araria in connection with Raniganj P.S. Case No. 355 of 2025, subject to condition as laid down under Section
