Mr. Anil Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-02-2020 Petitioner seeks bail in connection with Bakhtiarpur P.S. Case No. 322 of 2019, registered for the offences punishable under Sections 399, 402 of the Indian Penal Code and Sections 25(1-B)(a), 26 and 35 of the Arms Act. As per FIR police on information that some miscreants had assembled in the house of petitioner for preparation of committing dacoity raided the place and petitioner succeeded in fleeing away but some other accused persons were arrested, from whom there is recovery of one country-made pistol. It appears that petitioner is accused in three other cases.

Submission of learned counsel for the petitioner is that co-accused against whom there is allegation of recovery has been granted bail by co-ordinate Bench of this Court by order

Patna High Court CR. MISC. No.6835 of 2020(3) dt.27-02-2020 2/2 dated 8.1.2020 passed in Cr.Misc.No. 78226 of 2019 and one co-accused has been granted anticipatory bail by a co-ordinate Bench of this Court by order dated 14.2.2020 passed in Cr.Misc.No. 87221 of 2019 and petitioner is in custody since 25.11.2019.

Heard learned APP also.

In view of allegation and also criminal antecedent, I am not inclined to grant bail to the petitioner. However, once the charge has been framed petitioner may renew his prayer for bail. This application is, accordingly, dismissed.
