====================================================== CORAM: HONOURABLE JUSTICE SMT. SONI SHRIVASTAVA ORAL ORDER 28-05-2025 Heard learned counsel for the petitioner, learned APP for the State and learned counsel appearing for the informant.

2. The petitioner seeks bail in a case registered for the offences punishable under Sections 363, 365, 370, 366(A) of the Indian Penal Code and Section 79 of the J.J. Act.

3. The FIR has been lodged by an N.G.O. alleging human trafficking against the petitioner by stating that the petitioner was taking a girl towards Nepal from India without informing the family members of the girl.

4. Learned counsel for the petitioner submits that the allegation of human trafficking against the petitioner is completely wrong and as a matter of fact, the petitioner and the

No.7885 of 2025(5) dt.28-05-2025 2/3 victim girl were in a love relationship with each other and they were together going to Kathmandu, Nepal after getting married for working together in Nepal. During the course of investigation, the statement of the victim girl was recorded u/s 164 of the Cr.P.C. and the same is on record which shows that the victim girl has stated that she solemnized marriage with the petitioner at Kolkata and the petitioner was working at Nepal where she was going along with him after staying for 4-5 days at her sasural. It has further been stated by her that she was never kidnapped and she was rather going voluntarily with the petitioner and her parents also had no objection to the same. It is further submitted on behalf of the petitioner that the victim girl was also medically examined and as per the medical report, she appeared to be a major as her age was found about 18-19 years. It is next submitted that the petitioner has been languishing in custody since 02.06.2024 with no criminal antecedent.

5. Learned APP for the State and learned counsel appearing for the informant, however, oppose the prayer for regular bail.

Considering the above-mentioned facts and circumstances and particularly the statement of the victim recorded under Section 164 Cr.P.C., the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.

Patna High Court CR. MISC. No.7885 of 2025(5) dt.28-05-2025 3/3 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Raxaul (Hariya) P.S. Case No. 188 of 2024.
