The petitioner is languishing in jail since 13.05.2015 in a case instituted under Sections 304(B) and 201/34 of the Indian Penal Code.
As per allegation, it is a case of dowry death to the informant's daughter due to non-fulfilment of dowry demand by the petitioner.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 13.05.2015. Chargesheet has been submitted in the case. Petitioner has got no criminal antecedent. There is no allegation of tampering of evidence against the petitioner. From perusal of para-10 of the case diary, it
Patna High Court Cr.Misc. No.36998 of 2015 (3) dt.06-10-2015 would appear that the independent witness, namely, Meera Devi who happened to be neighbour of the deceased has very categorically stated that the deceased had committed suicide. Petitioner is the father-in-law of the deceased. There is no specific allegation against him. He is separate mess and property from the husband of the deceased.
On behalf of the State, it has been submitted that the petitioner is named in the FIR.
Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Shri Rajesh Pandey, Judicial Magistrate, Ist Class, Vaishali at Hajipur in connection with Tisiauta P.S.Case No.60 of 2014.
