Learned counsel for the petitioner is permitted to remove the defect(s), as pointed out by the office, if any, within a period of four weeks from today.

Petitioner seeks bail in a case registered for the offences punishable under Sections 363, 366(A)/34 of the Indian Penal Code.

Earlier the bail petition of the petitioner was rejected vide order dated 29.01.2022 passed in Cr. Misc. No. 27977 of 2021.

According to prosecution case, the petitioner along with other accused persons kidnapped the daughter of the informant by enticing her for the purpose of marriage. Learned counsel for the petitioner submits that petitioner has clean antecedent and he has falsely been

Vide order dated 08.02.2023 a report was called with regard to the present stage of trial. Report dated 10.02.2023 reveals that out of six charge sheet witnesses, up to 03.02.2023 five prosecution witnesses have been examined including the informant, victim and doctor and now only one charge sheet witness I.O. is yet to be examined.

The learned Additional Public Prosecutor has vehemently opposed the prayer for bail of the petitioner. In view of the report of the learned Trial Court, I am not inclined to enlarge the petitioner on bail in connection with Sessions Trial No. 319 of 2022 arising out of Mohammadpur P.S. Case No. 143 of 2019 pending in the court of learned Additional Sessions Judge- VI-cum-Special Juge, POCSO, Gopalganj.

Prayer is refused.

However, the learned Trial Court is directed to expedite and conclude the trial at the earliest. (Rajesh Kumar Verma, J) Vanisha/- U T
