JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 21-07-2017 Heard learned counsel for the petitioner, counsel appearing on behalf of the State and the Accountant General. From perusal of the counter affidavit of the Accountant General, Bihar and in particular, Annexure-R7/A, it appears that the Accounts Officer has written to the Block Development Officer, Barahat, Banka to provide "No Dues Certificate" so that the necessary action may be taken in the matter of payment of dues of the petitioner.

It appears that the respondent No. 6 is reluctant in the matter and as such uncalled for delay is causing in the payment of

Patna High Court CWJC No.3470 of 2017 (2) dt.21-07-2017 2/2 family pension and death-cum- retiral gratuity admissible to the petitioner.

In the peculiar circumstances, the respondent No. 6 is directed to take appropriate step for issuance of "No Dues Certificate" to facilitate the office of the Accountant General, Bihar to finalize the family pension of the petitioner including payment of due amounts by the Treasury Officer at the earliest. So far as the other grievance with regard to arrear of salary of the late husband of the petitioner is concerned, the petitioner may file a representation with full particulars about the arrears and the respondent No. 6 is directed to consider the representation and take appropriate decision at the earliest preferably within three months from the date of filing of the representation.

With the aforesaid observations and directions, the writ application stands disposed of.
