1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in connection with Raushanganj P.S. Case No.230/2023 registered for the offence punishable under Sections 323, 341, 307, 504, 506 of the Indian Penal Code.
3. Learned counsel for the petitioners submits that petitioners are persons with clean antecedent and petitioner
Patna High Court CR. MISC. No.10140 of 2024(2) dt.29-02-2024 2/3 no.3, 4 and 6 are women. It is next submitted that the informant falsely implicated the entire family members. It is next submitted that the informant alleges that on 31.07.2023 at about 8.00 P.M., the accused persons including the petitioners came to her house and started abusing and also damaged the drain which was constructed at her door. It is next alleged that on account of assault, she received injury on head and fainted and when her sons came to save her they were also assaulted. It is next submitted that from bare perusal of the allegation as alleged in the F.I.R., it would manifest that on a trivial issue, the occurrence is alleged to have taken place and the entire family members have been implicated with general and omnibus allegation.
4. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
5. Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Sri Sanjay Kumar, learned
