JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-09-2015 Learned counsel for the petitioner is permitted to make necessary correction in the petition, as prayed for. Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147,149,341,323,353,379,216A and 504 of the Indian Penal Code. The prosecution case is that the informant being a police officer saw on Platform no. 1 of Ara Railway station that 20-25 persons including co accused Ashok Kumar, Shivji Singh and Fauji creating nuisance then the informant tried to apprehend them when they raised slogans.

It is submitted by the learned counsel for the petitioner that the accusation is against the mob. Statement has been made

Patna High Court Cr.Misc. No.36588 of 2015 (2) dt.10-09-2015 2/2 in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Ara in connection with Ara Rail P.S. Case No.57 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
