The petitioners are in custody in connection with Mahesh Khunth P.S. Case No. 164 of 2018 registered for the offence punishable under Sections 30 (a) and 41 (1) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioners have no criminal antecedent. He further submits that petitioner No.1 is the driver of the vehicle whereas petitioner no.2 is the passenger travelling in the Magic vehicle bearing registration No. BR11L/6513. Learned counsel for the petitioners submits that in the instant case 264.6 liters foreign liquor was seized. He submits that petitioners are in custody

Considering the fact that petitioners have no criminal antecedent and they have remained in custody for nearly three months, let the petitioners named above be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Learned Special Judge, Excise Act, Khagaria in connection with Mahesh Kunth P.S. Case No. 164 of 2018.
