No.5789 of 2018 has been filed to expunge the name of the sole petitioner and to substitute the name of her two daughters as stated in paragraph 3 of the application.
The application is allowed. Let the name of the petitioner be expunged and the names of her daughters as stated in paragraph 3 be substituted in her place.
Learned counsel for the Nagar Parishad, DehriDalmiyanagar has placed before this Court a copy of the memo no.4425 dated 27.12.2017 issued under the signature of the
Patna High Court MJC No.3676 of 2016 (3) dt.30-08-2018 Executive Officer, Nagar Parishad, Dehri-Dalmiyanagar wherein it is stated that the dues on account of gratuity and leave encashment have already been paid on 11.01.2016. So far as the claim of group insurance is concerned, there is no provision for payment of group insurance in the Nagar Parishad. As regards the payment on account of provident fund dues, it is stated that the amount on account of P.F. have been deposited in her account. In the aforesaid view of the matter, this application is disposed off as having become infructuous. The petitioners will be at liberty to raise their claim if aggrieved by the order as contained in memo no.4425 dated 27.12.2017.
