JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-03-2020 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioner apprehends their arrest in connection with Kishanpur P.S. Case No. 103 of 2018 registered for the offences punishable under Sections 307, 380, 147, 149, 323, 341, 504, 506 of the Indian Penal Code.

Petitioners are said to have assaulted the informant and his other family members but admittedly, the police after due investigation, submitted charge sheet for the offence punishable under section 308 and other minor section of the Indian Penal Code and the learned Magistrate also took the

Patna High Court CR. MISC. No.5076 of 2020(2) dt.03-03-2020 2/2 cognizance only for the offences punishable under section 308 and other minor section of the Indian Penal Code. No doubt, altogether two person sustained injuries in the occurrence but the impugned order goes to show all the injureds sustained simple injury said to be caused by hard and blunt substance.

However, it is informed on behalf of the petitioners that one counter case was filed against the prosecution party and in the aforesaid counter case some persons also sustained injury. Considering the aforesaid facts and circumstances as well as submissions of the parties, let above named, petitioners, in the event of their arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st class, Supaul in Kishanpur P.S. Case No. 103 of 2018 subject to condition as laid down under Section 438(2) of the Cr.P.C. (Hemant Kumar Srivastava, J) N.K/- U T
