Motorcycle of the informant was taken away on 16.4.2015 but according to the prosecution case itself, petitioner was caught by the informant with stolen motorcycle on 17.4.2015 i.e. after one day of the alleged occurrence. Moreover, seizure list does not bear the signature of the petitioner.

Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Darbhaga in LNMU P.S. Case no. 117/2015.
