JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-01-2015 Petitioners are languishing in custody since 04.06.2014, 17.05.2014, 07.05.2014 in a case registered for the offences punishable under Section 394 of the I.P.C. Accusation is of robbing the driver and conductor and causing fire arm injury. The name of the petitioners sprang up during investigation.
It is submitted by learned counsel for the petitioners that none of the petitioners have been put on T.I.P nor recovery has been made from the petitioners and statements to that effect has been made in the petition. Considering the fact that petitioners have not been put on T.I.P, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Ara, Bhojpur in connection with Piro(Hasan Bazar) P.S. Case No. 46 of 2014. Since the petitioners have criminal antecedents, learned Court below will positively cancel the bail bonds of the petitioner, if the petitioners get substantially involved in similar nature of offence or defaults for two consecutive occasions during trial.
