The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 406, 384, 420 and 120B/34 of the Indian Penal Code. It is alleged that the petitioner in collusion with Panchayat Rojgar Sewak took the job card from several labourers and did not pay their wages under the MANREGA scheme in 2013-14.

It is submitted by learned counsel for the petitioner that the petitioner was neither Panchayat representative nor he was connected in any way with the Panchayat. The petitioner himself to be job card holder and maliciously he has been roped in the present case.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Birpur, Supaul in connection with Raghopur P.S. Case No. 34 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
