Petitioner is neither named in the first information report nor statement of the victim recorded under section 164 of the Cr.P.C. Petitioner was put on test identification parade but the victim did not identify him.
The impugned order of learned Addl. Sessions Judge reveals that in course of investigation, victim claimed to have identified the petitioner in the office of Sachivalaya Dy.S.P and except the aforesaid material as well as confessional statement of co-accused, there is nothing against him.
Petitioner does not have any criminal antecedent and is rotting in jail custody since 12.6.2015.
Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like
Patna High Court Cr.Misc. No.36289 of 2015 (2) dt.27-08-2015 amount each to the satisfaction of the learned Judicial Magistrate, Ist Class, Patna in Beur P.S. Case no. 107/2015.
