1. Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out of Triveniganj Police Station Case No. 14 of 2019, disclosing offences under Sections 341, 342, 323, 324, 307, 504, 379, 34 of the Indian Penal Code.
3. As per the prosecution story, on 28.12.2028, at 5 p.m., when the informant's son went to the house of petitioner no. 1 and demanded his wages, the petitioners brutally assaulted him by means of sharp cutting weapon.

4. Learned Counsel for the petitioners submits that the son of the informant, Shailendra Kumar Yadav, was driving the tractor of petitioner no. 1. There was a dispute regarding payment of wages due to which the petitioners have been made accused on the basis of false and concocted story. The occurrence as per the FIR had taken place on 28.12.2018, but the FIR has been lodged after a delay of 14 days on 12.01.2019. The allegation in the FIR is that petitioners assaulted the informant's son by sharp cutting weapon but the injury caused to the victim is simple in nature by hard and blunt substance. The police after investigation submitted final form not sending petitioner nos. 2 and 3 for trial, however, learned Magistrate differed with the police report and took cognizance against all the petitioners. Petitioners are having no criminal antecedent. The petitioners were given privilege of Section 41A of Cr.P.C. during course of investigation.

Having regard to the submissions made on behalf of the parties and taking into consideration the fact that there appears to be dispute regarding wages, the FIR has been lodged after an inordinate delay of 14 days on the basis of written report, the injury caused to the informant's son is simple in nature and the petitioners were given privilege of Section 41A
Patna High Court CR. MISC. No.7023 of 2025(3) dt.12-05-2025 3/3 of Cr.P.C., I am inclined to grant the petitioners privilege of anticipatory bail.
6. This application is, accordingly, allowed.
7. Let the petitioners, above named, in the event of their arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Supaul, in connection with Triveniganj Police Station Case No. 14 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure/Section 482(2) of the BNSS, 2023.
