The petitioner is in custody since 31-3-2014 in connection with Rupauli P.S.Case No. 125 of 2012.

It has been submitted on behalf of the petitioner that though he is not named in the F.I.R., he was taken into custody on the basis of confessional statement before the police by one Subodh Mandal. It is further submitted that another co-accused Shrawan Kumar alias Shrawan Yadav was also named along with this petitioner in the said confessional statement made before the

Patna High Court Cr.Misc. No.36193 of 2014 (4) dt.02-03-2015 2 / 2 police.

Considering the fact that the petitioner has been taken into custody only on the basis of extra- judicial confession which has no evidentiary value and also the fact that the accused Shrawan Kumar @ Shrawan Yadav has been extended the privilege of bail in Cr.Misc. No. 25700 of 2014-vide order dated 25-6-2014, let the petitioner Sanjay Yadav @ Fucho Yadav be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Purnea, in connection with Rupauli P.S. Case No. 125/12.
