JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 13-10-2023 Learned counsel for the petitioner has submitted that the petitioner had filed Cr. Misc. No. 74831 of 2022 for anticipatory bail. The petitioner vide order dated 11.01.2023 was directed to surrender and seek regular bail before the court below. While passing that order, it has been mentioned that it was the submission of the learned counsel for the petitioner at that time that the petitioner was regularly depositing the loan amount, which is not a fact.

2. The learned counsel has submitted that this observation, that the petitioner is regularly depositing the amount, is not a fact and he has not mentioned this fact in his

Patna High Court CR. MISC. No.22308 of 2023(5) dt.13-10-2023 2/2 bail petition.

3. Learned counsel for the petitioner wants the modification of that order to the extent stated above. The prayer is allowed.

4. With these observations, this criminal miscellaneous petition is disposed of.
