Petitioner apprehends arrest in connection with Hajipur Sadar P.S. Case No. 504 of 2020 registered for the offence punishable under section 30(a) of the Bihar Prohibition and Excise Act.
Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The vehicle which has been seized does not belongs to this petitioner as he has already sold the vehicle but registration could not be done. Petitioner has no criminal antecedent.
Patna High Court CR. MISC. No.16884 of 2021(2) dt.06-01-2022 2/2 Learned Addl. P.P. appearing for the State opposes the prayer for bail and submits that petitioner is the owner of the vehicle which has been seized and as such the anticipatory bail application is itself not maintainable. Considering the nature of allegations levelled, the materials available on record and the submissions advanced on behalf of the parties, this Court does not find it to be a fit case for grant of anticipatory bail to the petitioner. The same is, therefore, rejected.
