JUSTICE ASHUTOSH KUMAR ORAL ORDER 04-02-2019 The petitioner seeks bail in anticipation of his arrest in connection with Complaint Case vide C-2A No. 231 of 2017 in which cognizance has been taken under Sections 30(a), 37(b) and 37(d) of the Bihar Prohibition and Excise Act, 2016.

After some arguments, Mr. Mukesh Kumar, learned counsel for the petitioner seeks permission to withdraw this petition in order to enable the petitioner to surrender before the court below and seek bail.

Should such an application be filed on behalf of the petitioner, the court below shall take into account that a very small quantity of liquor was found from behind the shop
