2. The petitioner seeks bail in connection with Islampur P.S. Case No. 42 of 2000 dated 18.05.2000 registered for the offence punishable under Sections 302 and 201/34 of the Indian Penal Code.
3. The allegation against the petitioner is that he along with other accused persons is said to have murdered the brother of the informant by slitting his throat and dumped his body in a ditch.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in
Patna High Court CR. MISC. No.7635 of 2026(2) dt.04-02-2026 2/3 this case. It is submitted that the petitioner's name has not been mentioned in the F.I.R.. Only on the basis of suspicion, the petitioner has been made accused in this case. It is submitted that the named accused persons, who are main accused persons, have already been acquitted by the Trial Court vide Sessions Trial No. 438 of 2009, wherein, nine accused persons faced the trial and all were acquitted and thereafter vide Sessions Trial No. 554 of 2019, another coaccused Satpal Gadedi has also been acquitted. It is further submitted that the petitioner has no role in the said crime. The petitioner remained absconded due to which his trial was separated from other co-accused persons. The petitioner is in custody since 17.09.2025, having one criminal case against him and charge-sheet has been submitted in the case.
5. Learned A.P.P for the State opposes the prayer for bail of the petitioner.
6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties
