The petitioner seeks bail in a case registered for the offences punishable under sections 395 of the Indian Penal Code.

The petitioner is not named in the F.I.R. Nothing has been recovered from possession of the petitioner. The petitioner was arrested in connection with Motihari Town P.S. Case No. 899 of 2014 in which he is said to have confessed his guilt and also committed dacoity. Except the confessional statement of the petitioner, the I.O. could not collect any tangible material against the petitioner.

Considering the facts aforesaid, the petitioner

Patna High Court Cr.Misc. No.37339 of 2015 (2) dt.25-08-2015 above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri S. K. Shrivastava, Judicial Magistrate, 1st Class, Raxaul at Motihari in connection with Chhauradano P.S. Case No. 98 of 2014.
