The petitioner apprehends her arrest in connection with Barachati P.S. Case No. 676 of 2017, registered under Sections 30(a), 30(d), 38 and 47 of the Bihar Excise Act, 2016. The accusation is of recovery of 10 litres country made liquor from the house of the Muneshwari Devi (petitioner), wife of Muneshwar Chaudhary.

Learned counsel for the petitioner submits that, in fact, 10 litres country made liquor is said to be recovered from the joint house of the petitioner and at the time of raid, petitioner was not present at her house. Further submission is that petitioner, who is lady aged about 65 years, has no criminal

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of her arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Excise Judge, Gaya, in connection with Barachati P.S. Case No. 676 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
