Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 272,273,414,420,120(B) of the Indian Penal Code and Sections 30(a),32(ii),38(ii),41(i) of Bihar Prohibition and Excise Act, 2016.

Supplementary affidavit, disclosing criminal antecedent of the petitioner, is not on the record. Registry to place the same on the record.

Since the petitioner has got criminal antecedent under Bihar Prohibition and Excise Act, in my view, this is not a fit

Patna High Court CR. MISC. No.16712 of 2021(2) dt.23-11-2021 2/2 case for grant of anticipatory bail to the petitioner in connection with Saraiya P.S.Case No.382 of 2019 pending in the court of learned Special Judge, Excise Act, Muzaffarpur. Accordingly, prayer is refused.

Petitioner is directed to surrender within two weeks and pray for regular bail.
