Allegation is against co-accused Ajimuddin and Md. Noor that they caused injury at the stomach by a penetrating weapon, which caused death of the husband of the informant. No overt-act is alleged against the petitioner, rather he was not present at the time of occurrence of murder.
Submission of learned counsel for the petitioner is that the other co-accused persons have been granted bail by this Court vide order dated 29.03.2019, 30.05.2019, 18.07.2019, 03.09.2019, in Cr. Misc. No. 19327/2019 (AB), Cr. Misc. No.21156/2019, Cr. Misc. No.43539/2019 and Cr. Misc. No.55280/2019 (AB) respectively. Petitioner is in custody since
Patna High Court CR. MISC. No.7296 of 2020(2) dt.24-02-2020 2/2 17.10.2019, having no criminal antecedent and charge sheet has been submitted, as such there is no chance of tempering with the evidence.

In view of the above facts and circumstances, let petitioner be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Bhagalpur, in connection with Shahkund P.S. Case No.190 of 2018.
